What to put in your GDPR Privacy Statement?
4/18/2019 4:09:53 PM by Adam Brogden
Have you created and published your Privacy Statement? This is absolutely fundamental and failure to make this vital document available to your data subjects is likely to result in problems. Without a Privacy Statement you have absolutely no defence from GDPR complaints, claims, and enforcement action.

TPS Your Data
4/17/2019 11:48:44 AM by Adam Brogden
This is slightly different to the normal advice and information blogs. The ICO are running a campaign aimed at protecting elderly relatives, friends and neighbours after a funeral plan company was caught spamming thousands of older people. The aim of this blog is to simply support that campaign and remind everyone to make sure their relatives understand how these companies operate and to help keep them safe.

Don’t Buy GDPR Compliant Data
4/15/2019 12:07:29 PM by Adam Brogden
Because it’s not really GDPR compliant! There are many companies out there that will try to sell you GDPR compliant email or mobile number data and will offer you all sorts of guarantees, contracts, and warranties. These companies are usually called data brokers but might also go under the name of lead generation company, business development agency or something similar.

Don’t forget your ICO Renewal!
4/8/2019 11:11:22 AM by Adam Brogden
I just received my ICO reminder renewal reminder email. This comes from a weird email address so you might just miss it. The email states when my renewal is due and the cost but also information about the fixed penalty notice for failing to renew.

GDPR Annual Audit
4/5/2019 1:03:31 PM by Adam Brogden
Implementation of GDPR is not just a one-off exercise, although I fear most companies will treat it as such. GDPR should become part of how you operate. In fact adherence to GDPR principles should be how you operate.

Staff Training
4/4/2019 12:45:45 PM by Adam Brogden
GDPR requires you to train your staff. This seems obvious but many companies neglect this vital requirement and suffer the consequences. The fact is, the majority of data breach incidents are caused by human error and these are very difficult to stop. So, what should you do?

Clear Desk and Screen Policy
4/2/2019 2:10:10 PM by Adam Brogden
Having a clear desk could be considered as your first line of defence. If you have locked away all your sensitive information, there is then little chance of a random person spotting all the sensitive personal information you have on your desk or inadvertently removing it and having it somewhere else.

3/28/2019 10:28:01 AM by Adam Brogden
A Kent based Pension company has just been fined £40,000 for sending 2 million spam emails. The Pension company did get Data Protection advice from somewhere but this was deemed misleading by the ICO and didn't save them from this fine.

3/22/2019 9:39:06 AM by Adam Brogden
Whether you completed your GDPR last May or have not quite started yet, you should consider completing a GDPR audit. This will help you understand your current level of compliance and also identify any urgent issues that you really do need to address. GDPR can be quite daunting and it can be difficult to know where to start.

As part of your GDPR compliance it is most important that you train your staff and keep records of training completed. Training can be expensive and time-consuming but failure to train your staff could result in ICO fines or enforcement action.

£700,000 ICO Fine
3/14/2019 10:21:39 AM by Adam Brogden
The ICO has just find two companies £700,000 for persistent illegal marketing. The companies involved were generating huge volumes of traffic and promoting some pretty dubious products and the ICO has clearly taken appropriate action against them.

I am not going to make any comment at all about the current situation and lack of clear direction for companies, but it is important to tell you that if we leave the EU with no deal there could be serious impacts on the way you handle personal data.
